Please read these Terms and Conditions ("Terms") carefully before using wetoocare.com ("Website") and our services.
By clicking "I Agree" on our website or by booking any of our services, you (referred to as "User", "Client", or "You") are entering into a legally binding agreement with wetoocare.com ("We", "Our", or "Company").
If you do not agree to these Terms, please do not use our services.
wetoocare.com is a platform that provides non-medical assistance to patients or elderly individuals ("Patient") who require a companion for hospital visits, regular checkups, or other medical appointments.
We arrange trained assistants ("Assistant" or "Companion") who accompany the patient from their home to the hospital, assist them at the hospital, and drop them back safely home.
To use our services, you must meet the following conditions:
wetoocare.com is solely a companion and assistance service. We are not a medical service provider.
You expressly understand and agree that:
If the patient's condition deteriorates suddenly during the service, our Assistant will only help by calling an ambulance or emergency services and informing the family.
We will not be responsible for any medical consequences.
The User must provide complete and accurate written information about the patient's exact illness, current medical condition, medical history, allergies, physical/mental limitations (e.g., dementia, aggression), and any infectious disease at the time of booking.
The patient will be solely responsible for their valuables (cash, jewelry, mobile) during the hospital visit.
We are not responsible for medical negligence, wrong diagnosis, or delay in treatment by any hospital, doctor, or lab.
We will also not be responsible for any accident or delay during third-party transport.
If the user intentionally or accidentally hid important patient health information, and as a result, the patient's condition worsens, injury occurs, or death happens, wetoocare.com or its Assistant will have no responsibility in this.
If the patient does not follow instructions (like refusing a wheelchair or something else in their interest) and this causes any accident or injury, the patient themselves will be fully responsible for it.
Despite our best efforts, if any unusual situation arises or is caused by the patient, which is beyond our control (like natural disaster, accident in hospital, or spontaneous worsening of patient's illness or patient death, patient creating unusual situation themselves), the Company and Assistant will not be responsible for it.
In such a situation, the Assistant will only inform the family and emergency services.
In any situation, wetoocare.com's total financial liability for any claim will not exceed the amount paid by you for that specific booking.
Your personal and medical information will be used only to provide the service and will not be sold to any third party without your consent.
wetoocare.com reserves the right to refuse service to any user or close their account at any time, especially upon violation of these terms.
7.3.1-Any controversies, conflicts, disputes, or differences, arising out of these Terms shall be resolved by arbitration in Gorakhpur, Uttar-Pradesh , India in accordance with the Arbitration and Conciliation Act, 1996 for the time being in force, which is deemed to be incorporated by reference in this clause. The tribunal shall consist of 1 (One) arbitrator appointed by wetoocare. The language of the arbitration shall be English/Hindi. The parties to the arbitration shall keep the arbitration confidential, and not disclose to any person, other than on a need to know basis, or to legal advisors, unless required to do so by law. The decision of the arbitrator shall be final and binding on all the parties thereto. Each party to the arbitration shall bear its own costs with respect to any dispute.
